1. Acceptance of Terms

By accessing our website, requesting an estimate, entering into a service agreement, or using our services, you agree to these Terms. If you do not agree, please do not use our website or services.

2. Services

MBE Property Solutions provides property-related services, which may include:

Property management
Landscaping and lawn care
Property maintenance
Home improvement services
Exterior property services
Cleaning and upkeep
Seasonal property services
Other property-related services agreed upon with the customer

Specific services, pricing, schedules, materials, and responsibilities may be established in a separate estimate, proposal, work order, or service agreement.

3. Estimates and Pricing

Estimates provided by MBE Property Solutions are based on the information available at the time of the estimate.

Unless specifically stated otherwise:

Estimates are not guaranteed final prices.
Additional work requested by the customer may result in additional charges.
Hidden, concealed, damaged, or unforeseen conditions may require additional work and costs.
Material prices, labor requirements, site conditions, and other circumstances may affect the final price.
Work outside the original scope must be approved by the customer before being performed, except where immediate action is reasonably necessary to prevent additional property damage.

4. Customer Responsibilities

Customers agree to:

Provide accurate information regarding the property and requested services.
Provide reasonable access to the property when required.
Identify known hazards, property restrictions, underground utilities, irrigation systems, septic systems, or other relevant conditions.
Obtain any permissions or approvals that are the customer's responsibility.
Ensure that pets and personal property are secured when necessary.
Make payments according to the applicable agreement or invoice.

Customers are responsible for damage, delays, or additional costs resulting from inaccurate information, restricted access, undisclosed conditions, or failure to satisfy their responsibilities.

5. Scheduling and Access

Service dates and arrival times may vary due to weather, emergencies, material availability, staffing, traffic, equipment issues, or other circumstances beyond our reasonable control.

MBE Property Solutions may reschedule work when conditions make performing the service unsafe or impractical.

For recurring services, customers are responsible for providing reasonable and consistent access to the property.

6. Payments

Payment terms will be stated in the applicable estimate, invoice, proposal, or service agreement.

Unless otherwise agreed in writing:

Invoices are due according to the payment terms stated on the invoice.
Customers are responsible for applicable taxes, fees, materials, and approved additional work.
Late or unpaid balances may result in suspension or termination of services.
MBE Property Solutions may pursue lawful collection remedies for unpaid amounts.

Any deposits or advance payments will be handled according to the applicable agreement and applicable law.

7. Cancellations

Customers may cancel or reschedule services subject to the terms of their individual service agreement.

Cancellation fees may apply when labor, materials, equipment, subcontractors, or other resources have already been committed to a project.

For recurring services, cancellation requirements may be established in the customer's service agreement.

8. Recurring Services

For recurring property maintenance or management services, the frequency and scope of services will be established in the applicable service agreement.

Recurring services may be modified, suspended, or terminated in accordance with the agreement between MBE Property Solutions and the customer.

9. Third-Party Contractors and Vendors

MBE Property Solutions may use independent contractors, subcontractors, suppliers, vendors, or other third parties when appropriate to perform or support services.

Customers authorize MBE Property Solutions to coordinate such services when they are included within an agreed scope of work.

Third-party services may be subject to additional terms, warranties, or limitations established by the third-party provider.

10. Property Conditions and Existing Damage

MBE Property Solutions is not responsible for pre-existing damage, defective construction, deteriorated materials, concealed conditions, or problems that were not reasonably apparent before work began.

If existing conditions create a safety concern or prevent completion of the requested service, we may stop or modify the work until the issue is addressed.

11. Weather and Force Majeure

MBE Property Solutions is not responsible for delays or inability to perform services caused by circumstances outside our reasonable control, including severe weather, natural disasters, government actions, utility interruptions, labor shortages, material shortages, equipment failures, emergencies, or other unforeseen events.

12. Safety

MBE Property Solutions may refuse, suspend, or modify work when conditions present an unreasonable risk to employees, contractors, customers, visitors, property, or equipment.

Customers agree not to interfere with workers while services are being performed.

13. Photos and Property Documentation

When reasonably necessary for estimating, documenting, performing, or verifying services, MBE Property Solutions may photograph or otherwise document property conditions.

Customer information and property documentation will be handled in accordance with applicable privacy laws and any applicable privacy policy.

14. Website Use

You agree not to:

Use our website for unlawful purposes.
Attempt to gain unauthorized access to our systems.
Interfere with website functionality or security.
Submit fraudulent or misleading information.
Copy, reproduce, or distribute website content without permission.
Use automated systems to improperly access or collect website information.

We may modify, suspend, or discontinue portions of the website at any time.

15. Intellectual Property

Unless otherwise stated, the content of the MBE Property Solutions website, including logos, branding, text, graphics, photographs, designs, and other materials, is owned by or licensed to MBE Property Solutions and is protected by applicable intellectual property laws.

However, certain property conditions and outcomes cannot be guaranteed. Results may depend on weather, property condition, materials, customer actions, third-party services, and other factors outside our control.

17. Limitation of Liability

To the fullest extent permitted by applicable law, MBE Property Solutions will not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our website or services.

Nothing in these Terms is intended to waive or limit liability that cannot legally be waived or limited under applicable law.

18. Indemnification

To the extent permitted by law, customers agree to indemnify and hold harmless MBE Property Solutions and its owners, employees, contractors, and agents from claims, damages, losses, liabilities, and expenses arising from the customer's violation of these Terms, misuse of services, or failure to comply with their responsibilities.

19. Disputes

The parties agree to make reasonable efforts to resolve disputes directly before pursuing formal legal action.

Nothing in these Terms prevents either party from exercising rights or remedies that cannot legally be waived.

20. Governing Law

These Terms will be governed by and interpreted in accordance with the laws of the applicable jurisdiction in which MBE Property Solutions provides the relevant services, unless otherwise required by law or stated in a separate written agreement.

21. Changes to These Terms

MBE Property Solutions may update these Terms from time to time. Updated Terms may be posted on our website with a revised effective date.

Your continued use of our website or services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

22. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.

23. Entire Agreement

These Terms, together with any applicable estimate, proposal, invoice, work order, service agreement, privacy policy, or other written agreement between MBE Property Solutions and the customer, constitute the agreement governing the applicable services.

If a specific written service agreement conflicts with these Terms, the specific agreement will control with respect to that service.
